3) Collection of general data and information
We collect a series of general data and information each time the website is accessed by a data subject or an automated system. This general data and information is stored in the server's log files. Due to legal regulations, the Bergblut GmbH website contains information that enables quick electronic contact with our company and direct communication with us, which also includes a general address for so-called electronic mail (email address). If a data subject contacts the controller by email or via a contact form, the personal data transmitted by the data subject are automatically stored. Such personal data transmitted on a voluntary basis by a data subject to the controller are stored for the purposes of processing or contacting the data subject. This personal data is not passed on to third parties.
5) Data processing during the ordering process and opening of a customer account
We process our customers' data as part of the ordering process in our online shop in order to enable them to select and order the selected products and services, as well as to pay for and deliver them or execute them.
The data processed includes inventory data, communication data, contract data, payment data and the persons affected by the processing include our customers, interested parties and other business partners. The processing is carried out for the purpose of providing contractual services in the context of operating an online shop, billing, delivery and customer services. We use session cookies to store the shopping cart contents and permanent cookies to store the login status.
The processing is carried out on the basis of Art. 6 Paragraph 1 Letter b (execution of order processes) and c (legally required archiving) GDPR. The information marked as required is necessary to establish and fulfill the contract. We only disclose the data to third parties in the context of delivery, payment or within the scope of legal permissions and obligations to legal advisors and authorities. The data is only processed in third countries if this is necessary to fulfill the contract (e.g. at the customer's request during delivery or payment).
Users can optionally create a user account, in particular where they can view their orders. During registration, the required mandatory information is communicated to users. User accounts are not public and cannot be indexed by search engines. If users have canceled their user account, their data relating to the user account will be deleted, provided that their retention is necessary for commercial or tax law reasons in accordance with Art. 6 Paragraph 1 Letter c of GDPR. Information in the customer account remains until it is deleted and then archived in the event of a legal obligation. It is the responsibility of users to back up their data before the end of the contract if the contract is canceled.
When registering and re-registering, as well as using our online services, we save the IP address and the time of the respective user action. The data is saved on the basis of our legitimate interests, as well as the user's interests in protection against misuse and other unauthorized use. This data is generally not passed on to third parties unless it is necessary to pursue our claims or there is a legal obligation to do so in accordance with Art. 6 Paragraph 1 Letter c of GDPR.
Deletion occurs after expiry of statutory warranty and comparable obligations, the necessity of retaining the data is reviewed every three years; in the case of statutory archiving obligations, deletion occurs after their expiry (end of commercial law (6 years) and tax law (10 years) retention obligation).
6) Transfer of personal data for creditworthiness or identity checks and scoring for direct debit
If you choose the SEPA direct debit procedure as a payment method, payment processing will be carried out by the technical service provider Paymill GmbH, St.-Cajetan-Straße 43, 81669 Munich, which will pass on the customer's billing data (name, address, account number, bank code or IBAN and BIC, invoice amount, currency and transaction number) that the customer provided during the ordering process to the acquirer Lufthansa AirPlus Servicekarten GmbH, Dornhofstr. 10, 63263 Neu-Isenburg or Wirecard Bank AG, Einsteinring 35, 85609 Aschheim. 7) Subscription to our newsletter
On the Bergblut GmbH website, users are given the opportunity to subscribe to our company's newsletter. The input mask used for this purpose determines which personal data is transmitted to the controller when ordering the newsletter.
Bergblut GmbH informs its customers and business partners at regular intervals by means of a newsletter about company offers. Our company's newsletter can only be received by the data subject if (1) the data subject has a valid e-mail address and (2) the data subject registers for the newsletter. For legal reasons, a confirmation e-mail will be sent to the e-mail address entered by a data subject for the first time for the newsletter using the double opt-in procedure. This confirmation e-mail is used to check whether the owner of the e-mail address as the data subject has authorized receipt of the newsletter.
When registering for the newsletter, we also store the IP address assigned by the Internet service provider (ISP) of the computer system used by the data subject at the time of registration, as well as the date and time of registration. The collection of this data is necessary in order to be able to trace the (possible) misuse of the e-mail address of a data subject at a later date and therefore serves to legally protect the controller.
The personal data collected when registering for the newsletter is used exclusively to send our newsletter. 7.1 Newsletter dispatch via MailChimp
Our e-mail newsletters are sent via the technical service provider The Rocket Science Group, LLC d/b/a MailChimp, 675 Ponce de Leon Ave NE, Suite 5000, Atlanta, GA 30308, USA ( http://www.mailchimp.com/ ), to whom we pass on the data you provided when registering for the newsletter. For the evaluation, the emails sent contain so-called web beacons or tracking pixels, which are single-pixel image files that are stored on our website. 8. Integration of the Trusted Shop Trustbadge
The Trusted Shops Trustbadge is integrated into this website to display our Trusted Shops seal of approval and any reviews collected, as well as to offer Trusted Shops products to buyers after an order has been placed.
This serves to safeguard our legitimate interests in optimal marketing by enabling secure shopping in accordance with Art. 6 Paragraph 1 Clause 1 Letter f of GDPR, which prevail within the framework of a balancing of interests. The Trustbadge and the services advertised with it are an offer from Trusted Shops GmbH, Subbelrather Str. 15C, 50823 Cologne. When you call up the Trustbadge, the web server automatically saves a so-called server log file, which also contains your IP address, the date and time of the call, the amount of data transferred and the requesting provider (access data) and documents the call. Individual access data is saved in a security database for the analysis of security irregularities. The log files are automatically deleted no later than 90 days after they are created.
Further personal data will be transferred to Trusted Shops GmbH if you decide to use Trusted Shops products after completing an order or if you have already registered to use them. The contractual agreement between you and Trusted Shops applies. For this purpose, personal data is automatically collected from the order data. Whether you as a buyer are already registered to use a product is automatically checked using a neutral parameter, the email address hashed using a cryptographic one-way function. Before transmission, the email address is converted into this hash value, which Trusted Shops cannot decrypt. After checking for a match, the parameter is automatically deleted.
This is necessary to fulfill our and Trusted Shops' overriding legitimate interests in providing buyer protection linked to the specific order and transactional evaluation services in accordance with Art. 6 Paragraph 1 Clause 1 Letter f of GDPR. 9) Advertising by post
Based on our legitimate interest in personalized direct advertising, we reserve the right to store your first and last name, your postal address and - if we have received this additional information from you as part of the contractual relationship - your title, academic degree, year of birth and your professional, industry or business name in accordance with Art. 6 (1) (f) GDPR and to use it to send you interesting offers and information about our products by post.
You can object to the storage and use of your data for this purpose at any time by sending a corresponding message to the person responsible.
10) Data processing for order processing
10.1 To process your order, we work with the following service provider(s), who support us in whole or in part in the implementation of concluded contracts. Certain personal data is transmitted to these service providers in accordance with the following information. The personal data we collect is passed on to the transport company commissioned with the delivery as part of the contract processing, insofar as this is necessary for the delivery of the goods.
As part of the fulfillment of contracts, we use payment service providers on the basis of Art. 6 Para. 1 lit. b. GDPR. If the goods are delivered by the transport service provider GO!
